I don't want to listen again, lut thinking it over am a bit confused
about the Dower House. It is owned by Matt, but in trust with the
proceeds of rent going to Lilian? Is Justin then paying rent to the
trust which Lilian gets? If he thought she owned the house was he
always paying rent to her? I suppose initially they were not living in
it together, but now she is there too is that odd?

I think it should remain Lilian's. If it is in trust for her does that
mean Matt can't get it back? She needs a house that is indisputably
hers. I don't trust Matt or Justin really and think at some stage she
might not want to be living in a house that belongs to one of them.
Did Justin seem a bit hesitant about getting married in a hurry? He is
making two kinds of noises, it seems to me.

He is doing the adores Lilian one but also the trips to London and
evasiveness about the wedding seem odd. I am just suspicious.

According to Lilian, it doesn't belong to Matt any more as he
transferred it to the trust, with Lilian as the sole beneficiary. She
didn't say who it would revert to, after her death, or what would happen
to the money, if the trustees agreed to sell the house to Justin. It
may be that the money would be invested and that Lilian would get the
interest/dividends but I don't think that's certain.

I think the rent would have gone to Lilian, not to Matt or to the trust.

Like you, I don't trust either of them and I hope Lilian doesn't allow
Justin to buy her out. Justin definitely sounded very hesitant about
getting married soon, despite having been pushing for that, not long
ago. I thought his reaction to the news about the house was that of a
bully; unwilling to discuss the situation, uninterested in how Lilian
felt about it but just ordering her around.

I strongly suspect that, now that Lilian is fulfilling the wife role,
he's already filled the vacancy for a bit on the side.

The property is in a trust and according to Lilian she is the sole
beneficiary. We do know that Matt had put into a trust but not the
terms of the trust.

Yes - but she has not told Leachworthy that she has rented it out - that
may actually not be permitted under the Trust. It seems she has not
played fair with the Trustees/

The Trust was created to keep the Dower House from Matt's creditors
following his spot of bother with the law. If Matt could have got it
back then the creditors could have got the value.

It's a solicitor, one Rupert Leachworthy, but it has since transpired
that Matt is another trustee which seems to confirm that the set up is
well dodgy.
The Trustees merely have to execute the powers in the deed document. If
the Trust is for the benefit of Lilian then it is important she is not a
Trustee - but otherwise it can be anyone.

However I am not sure if Matt's conviction is spent or unspent. If
unspent and as it involved dishonesty then he cannot be a Trustee. Does
he remain bankrupt? That would also disbar him.

He was convicted in Oct 2009 and was given an 18 month sentence serving
9 months. So that would be on his record for four years.

So providing he is a discharged bankrupt, has had the ability to be a
director re-instated (it is usually for something like 5 years) and the
conviction is spent.

Looks to me like he can be a Trustee.

Well, yes, 'Rupert and I go back a long way' says it all. Maybe Rupert's
as dodgy as Matt and Chalky, and it's not truly 'in trust' at all.
